PARTICIPANT WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT
MYSTERY MILES — OCTOBER 17, 2026
This Participant Waiver, Release of Liability, and Assumption of Risk Agreement (the “Agreement”) is a legally binding agreement between you (the “Participant”, “you”, and/or “your”, including capitalized and uncapitalized references) and Anonymous Warrior LLC (“we,” “us,” and/or “our”, including capitalized and uncapitalized references). By checking the acceptance box during registration, you represent, warrant, covenant, and agree that you have read, understand, and agree to all terms and provisions in this Agreement. Please read carefully before completing your registration.
1. Event Description
Mystery Miles is a virtual running event organized by Anonymous Warrior LLC. The event takes place on Saturday, October 17, 2026 (“Race Day”). Participant understands, covenants, and agrees that Participant will complete a self-guided run or walk at a location of Participant’s own choosing.
Participant understands and agrees that the exact distance of the event will not be disclosed prior to Race Day. Participant understands and agrees that the distance will fall within a minimum of 3.1 miles (5K) and a maximum of 6.2 miles (10K), and that the specific distance will be communicated via email on the morning of Race Day. Anonymous Warrior LLC will send an email to Participant on Race Day advising Participant of the actual race distance, and this is the only notification Participant will receive regarding the distance. Anonymous Warrior LLC may also share this information on social media channels as a courtesy but is under no obligation to do so and bears no responsibility for Participant’s failure to receive or see such supplemental communications. Anonymous Warrior LLC bears no responsibility for Participant’s failure to receive the Race Day email due to spam filtering, incorrect email address provided at registration, or any other delivery failure outside of Anonymous Warrior LLC’s control.
By registering, Participant covenants and agrees to complete a distance between the stated minimum and maximum without advance knowledge of the precise figure and accepts this uncertainty as a core and intentional feature of the event.
2. Registration, Fees, and Cutoff
Participant understands and agrees as follows:
• Registration is completed through Anonymous Warrior LLC’s online store and requires payment of the applicable entry fee of $40, which includes one (1) event t-shirt in the size selected at checkout.
• The shirt is non-refundable and non-exchangeable, as shirts are ordered in quantities based on confirmed registrations at the time of registration close.
• All registration closes on October 8, 2026, at 11:59 PM Eastern Time. Anonymous Warrior LLC reserves the right to close registration at any time at its sole discretion.
• All sales are final. Entry fees are non-refundable except where required by law.
• Participant represents, warrants, and agrees that Participant is at least 18 years of age as of the date of registration. Anonymous Warrior LLC does not accept registrations on behalf of, and will not knowingly permit participation by, any individual under the age of 18. By registering, Participant represents and warrants that Participant meets this age requirement.
3. Race Day Requirements and Leaderboard Submission
To be eligible for inclusion on the official Mystery Miles leaderboard, Participant covenants and agrees to:
1. Complete the announced distance on October 17, 2026.
2. Submit a screenshot or photo clearly displaying Participant’s completed distance and time via email to customerservice@anonymouswarrior.com no later than 11:59 PM Eastern Time on October 17, 2026.
Participant understands and agrees that if Participant does not submit qualifying proof by the stated deadline, Participant will not appear on the leaderboard but remains a valid event participant for all other purposes, including shirt fulfillment where applicable.
Participant understands and agrees that official leaderboard results will be published on or around October 18, 2026, and that Anonymous Warrior LLC reserves sole discretion to verify, adjust, exclude, or remove any submitted result it reasonably believes to be inaccurate, fraudulent, or submitted in bad faith.
4. Awards and Fulfillment
The following awards will be presented based on submitted leaderboard results:
• The fastest overall recorded time among male participants will receive a custom award.
• The fastest overall recorded time among female participants will receive a custom award.
• The group with the fastest average time across all group members, as determined by submitted leaderboard results, will receive a custom award. To be eligible for group award consideration, all group members must submit qualifying results under the same group name provided at registration.
Anonymous Warrior LLC’s determination of all award recipients based on submitted results is final.
Event shirts and any applicable awards will be mailed to the address provided at registration within two (2) weeks following Race Day. Anonymous Warrior LLC is not responsible for delivery delays caused by shipping carriers or inaccurate addresses provided by Participant.
5. Dedications and Group Recognition
Participant may optionally dedicate Participant’s individual performance to a person of Participant’s choosing by entering a name in the “Dedicated To” field at registration. If selected, the dedicated name will be published in a “Dedicated To” column alongside Participant’s leaderboard entry. This field is optional and independent of group registration.
Participants may optionally register as part of a group by entering a group name in the “Group Name” field at registration. A “Group” is defined as three (3) or more registered Participants who identify themselves under the same group name at registration. Groups that complete the event and submit qualifying results under their shared group name will receive recognition in a dedicated group division on the published leaderboard. Group members may individually choose to complete the “Dedicated To” field or leave it blank, group registration does not require a shared dedication.
Participant understands, represents, warrants, covenants, and agrees to the following regarding dedications:
• Participant is solely and exclusively responsible for obtaining any necessary permission or consent from the individual being named in a dedication.
• Anonymous Warrior LLC does not verify the accuracy of any dedication, Participant’s relationship to the named individual, or the named individual’s consent, and bears no responsibility for any dispute, claim, or harm arising from a submitted dedication.
• Anonymous Warrior LLC reserves the right, in its sole discretion, to decline, edit, or remove any dedication it deems inappropriate, offensive, or otherwise unsuitable for publication.
• Anonymous Warrior LLC is not responsible for typographical errors in names submitted by Participant.
6. Assumption of Risk
Participant understands and agrees that running and other physical activity carry inherent risks, including but not limited to physical injury, heat-related illness, cardiac events, musculoskeletal injury, dehydration, encounters with traffic or terrain hazards, and, in rare cases, death. These risks exist regardless of the precautions taken by Participant or Anonymous Warrior LLC.
Because Mystery Miles is a self-guided virtual event, Participant further understands, represents, warrants, covenants, and agrees as follows:
• Participant will, and is solely and exclusively responsible and liable for, selecting a location, route, surface for running and or walking, that is safe, and in excellent condition, and well suited to those activities.
• Anonymous Warrior LLC has no ability, responsibility, or liability whatsoever for the safety, or condition, of the location, route, and/or surface selected by Participant, and has no ability to control, or supervise, Participant’s performance to complete Mystery Miles.
• Participant is solely and exclusively responsible for assessing and confirming Participant’s own physical and mental fitness and ability to participate in the Mystery Miles Event.
• Participant will consult with a physician prior to Race Day to confirm that they are physically and mentally fit and able to fully participate in the Mystery Miles Event.
• Participant will comply with any and all obligations, requirements, covenants, and agreements contained in this Agreement.
• Participant voluntarily assumes full responsibility for any and all known and unknown, foreseeable and unforeseeable, likely and unlikely, risks, losses, damages, liabilities, personal injuries, and/or death, that might be sustained by Participant and/or any other individual in connection with the Mystery Miles event, whether arising before, during, or after the event.
7. Release of Liability and Indemnification
In consideration of being permitted to participate in Mystery Miles, on behalf of Participant, and Participant’s heirs, executors, personal representatives, administrators, family members, and assigns/transferees, hereby releases, waives, discharges, and covenants not to sue or make any claim against Anonymous Warrior LLC and its owners, members, managers, managing members, officers, directors, contractors, employees, representatives, agents, and any other individual or entity on its behalf and/or acting in connection with Anonymous Warrior LLC (collectively, the “Released Parties”) from any and all liabilities, claims, demands, actions, damages, obligations, losses, lawsuits, attorney fees, costs, expenses, personal injuries, property damages, death, other injuries, causes of action, and any and all other obligations of any nature arising out of, or related to, and/or that may be sustained by Participant in connection with the Mystery Miles event, while Participant is at any location for the Mystery Miles Event, including at all times before, during, and after the Mystery Miles event.
Participant further covenants and agrees to indemnify, defend, and hold harmless the Released Parties from any and all liabilities, claims, demands, actions, damages, obligations, losses, lawsuits, attorney fees, costs, expenses, personal injuries, property damages, death, other injuries, causes of action, and any and all other obligations of any nature arising out of, or related to, and/or that may be sustained by Participant in connection with the Mystery Miles event, including reasonable attorneys’ fees, that the Released Parties may incur due to Participant’s participation in the event, to the fullest extent permitted by North Carolina law.
This release does not apply to claims arising from the gross negligence or willful misconduct of the Released Parties, to the extent such limitation is required by applicable law.
8. Photo, Video, and Content Release
Participant represents, warrants, and covenants that Participant grants Anonymous Warrior LLC a non-exclusive, royalty-free, worldwide right to use any photographs, videos, screenshots, results, or testimonials submitted by or depicting Participant in connection with Mystery Miles, for purposes including but not limited to social media, marketing, advertising, and promotional materials, without further compensation or notice. Participant who does not wish to grant this right covenants and agrees to notify Anonymous Warrior LLC in writing prior to Race Day.
9. Medical Fitness Acknowledgment
Participant represents, warrants, and agrees that Participant is physically and mentally fit and has not been advised by a medical professional against participating in an event of this nature or in the Mystery Miles event specifically. Participant covenants and agrees to assume full responsibility for monitoring Participant’s own physical condition throughout the Mystery Miles event.
10. Governing Law
Participant understands and agrees that this Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles, and that any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.
11. Severability
Participant understands and agrees that if any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.
12. Entire Agreement
Participant understands and agrees that this Agreement constitutes the entire agreement between Participant and Anonymous Warrior LLC with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements, representations, or understandings, whether written or oral.
13. Acknowledgment
BY CHECKING THE BOX AT REGISTRATION, PARTICIPANT ACKNOWLEDGES THAT PARTICIPANT HAS READ THIS ENTIRE AGREEMENT, UNDERSTANDS ITS TERMS, AND VOLUNTARILY REPRESENTS, WARRANTS, COVENANTS, AND AGREES TO BE BOUND BY IT. PARTICIPANT ACKNOWLEDGES THIS IS A LEGALLY BINDING AGREEMENT AND THAT PARTICIPANT IS GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, BY ACCEPTING THESE TERMS.
